What Actually is in the Affordable Care Act?

What follows is one of a series of facts on what is included in the Affordable Care Act. Readers can come to their own conclusions as to the value of the rule and whether the rule should or should not be part of our country’s health care system.

Providing Access to Insurance for Uninsured Americans with Pre-Existing Conditions

A Pre-Existing Condition Insurance Plan (PCIP) provides new coverage options to individuals who have been uninsured for at least six months because of a pre-existing condition. States have the option of running this new program in their state. If a state has chosen not to do so, a plan has been established by the Department of Health and Human Services in that state. This program serves as a bridge to 2014, when all discrimination against pre-existing conditions will be prohibited. 

What This Means for You:

The Pre-Existing Condition Insurance Plan makes health coverage available to you if you are a U.S. citizen or reside here legally, you have been denied health insurance because of a pre-existing condition, and you’ve been uninsured for at least six months.

Please provide an accurate citation for this statement in the ACA. If this is opinion or conjecture on the part of a government bureaucrat or some other self proclaimed "expert", please identify it as such.

Also, please provide the projected cost overall for providing this benefit. The CBO supposedly "scored" the bill costs, but already has shown their original inaccurate numbers at the time of passage go from just breaking even when ten years of taxes goes to pay for seven years of benefits, to a massive deficit that will add over a trilion to the national debt in that period.

This ill conceived law already has become the largest tax increase in history, is unsustainable under the current funding mechanism, and is based upon dishonest claims of cutting $500 billion form medicare from stopping "waste, fraud and abuse".

How much progress in eliminating "waste fraud and abuse" in Medicare since the law was passed?

This law has been perhaps the greatest obstacle to economic recovery and hiring in small businesses we've seen since WWII.

Kill this law, get Obama out of the WH and take over the Senate with fiscally responsible Senators and this economy will take off like a rocket!

Den ise, as you SHOULD know, the economy BOOMED from 2002 to 2008 due to the tax cuts! in 2002, following the incredible human and economic disaster on 9/11, the Gross Domestic product grew from about 10.6 trillion dollars to about 14.3 trillion in 2008. After 2008, and the Dem congressional policies started affecting the economy, we went into the great recession that the anti business policies of Obama, Reid and Pelosi have failed miserably to address.

What happened to income tax revenues in that period? They rose from about 800 billion in 2004 to over 1.2 trillion in 2008. Anyone with the slightest knowledge of economics knows that decreasing tax RATES increases tax REVENUES if the tax cuts are directed at private investment.

Denise, if you were disatisfied with the 34% increase in our economy created by the bi-partisan tax cuts, how badly will you criticize Obama's anemic GDP increase results, and his destructive attempts to stifle private investment in his divisive "class warfare" policies?

I'd also like to add that this law has not been the "greatest obstacle to economic recovery and hiring in small businesses we've seen since WWII". I think Bob is instead referring to the unregulated financial markets that the Republicans, beginning with Reagan (post depression at least) pushed so hard for.

Insurance companies must offer coverage to individuals with pre-existing conditions at a rate no higher than 2.5 times a healthy person's rate. If the healthy person's rate is $500 per month, then the pre-exist rate will be $1,250 per month. If you make $50,000 a year, you might get a tax write-off of up to 2% of your income or $1,000. Therefore, you will be responsible for an annual payment of $14,000 on an after tax income of about $40,000 per year. Health care costs are expected to increase 7% per year. If you believe you can't afford it, due to rent, car payment, food, etc, you will be taxed 2.5% of your income in 2016, or $1,500, further reducing your ability to cover your daily costs ~ and you will still be uninsured. This Act is not "affordable," nor will it reduce the uninsured. Employers are plotting to dump their health insurance benefits because it will be cheaper to pay the fine, putting millions more into the government plans which will soon find there is not enough money to provide the best for everyone. Yes, we have all heard Boehner (and others) claim that the United States has the best healthcare in the world. But saying it over and over again doesn't change the fact that the United States actually ranks 37th (in large part because so many of us are uninsured).

Denise, did you actually bother to read your reference? What the story said was that the US ranked 15th out of 191 nations, even when the heavily political issues of how many people are insured and "social justice" issues were included. When only quality of care delivered is included, we're near the top.

The 37th rating was not based on the heavily weighted political issues, but ALSO included biased personal opinions of the anti-American committee who are STRONGLY supportive of empowering government over the people.

The fact is, Denise, that the most reliable measure of healthcare quality is the free market where there is a choice of health care systems. I'm looking for data, but from what I've heard from quality medical facilitities that treat cancer and coronary disease in the US their instituions are the most sought after by those for whom money isn't an issue, and they get the same care Americans do when they go to these hospitals.

The World Health Organization ranking was misleading. The proof of the quality of healthcare in America is that so many people from around the world come here for their extraordinary health care needs and not any of the 36 nations with an alleged better health care system. In fact many of these folks come from the 36 with a better system.
This law creates 16,000 new IRS agents but not a single new doctor or nurse. Nothing improves health care and international rankings like a military division worth tax enforcers to improve medical services.

Paul, actually read the article. The ranking isn't based on quality of care delivered. It's based on socialists ideas of "social justice" and biased subjective opinions.Only one of the five categories actually relates to quality of care provided by the health care system. See response to Denise above.

Even using those four of five "political" measures in the study, we rank 15th of 191 (top 8%)

Go ahead and sign up for the Illinois program and see how many doctors will accept your plan. I know State of Illinois workers whose doctors and dentists make them pay upfront because it takes nearly a year to be reimbursed by the State. Last I heard, the state was $500 billion behind in bill payments and they're already gutting Medicaid and closing mental health institutions. I believe yesterday's Trib had an article about all the health care cuts being made in Illinois.

Hey Debbie, go have a look at some statistics of Romneycare in Massachusetts. You'll find that the plan is pretty much the same as Obamacare, costs are going down, and more than 98% of the states residents are insured.

You can speculate all you like about how much this plan is going to damage the economy, cost too much, etc.. but nothing is better to look at than a working real life example, which is exactly what we have in Massachusetts.

Actually the state does not pay the claims for the Uninsured Americans with Pre-Existing Conditions benefit. The Federal government does. So getting the plan accepted by health care providers is a non issue. See the following for how this benefit actually works in Illinois and how much it will cost the uninsured with pre-existing conditions.

Uh..Paul...something that works on a STATE level in Massachusetts isn't proof that'll EVER work at a FEDERAL level. Something that works in the New England states; won't necessarily work in a state like Louisiana...or California. So you can't even use "Romneycare" as any sort of example of that...
What you can use "Romneycare" as an example for is...Romney listened to the PEOPLE and did what THEY WANTED. Some polls I've heard about (from news radio stations) show that the American people polled are hovered over the 50% mark of not being in favor of this TAX. Lets not call it a law anymore...its only constitutional as a TAX -- and people are over looking how much more in TAX they'll be paying.

It's actually simple. Before the mandate, most type of people that purchased health insurance have been those that need it, aka sick people. Therefore, the insurance companies were at higher risk of losing money, and had bigger pay-outs. With the mandate, everyone has to have health insurance, so the costs are spread out amongst everyone. In addition, the 80/20 rule forces the insurance companies to pay 80% of premium dollars towards healthcare. If they violate that rule, they have to pay back to the customers in the form of a rebate.

So, you have costs spread out among more people (therefore you have each individual paying less) and you have a premium cap that is a function of healthcare expenditures. Also, since everyone will be covered, everyone will be more likely to visit their doctor regularly (or at least more frequently), thereby increasing the incidence of lower cost preventive care (as opposed to someone putting off the doctor visit because they don't have insurance and ending up in the ER with a much larger bill).

It will cost the taxpayers 1.76 trillion over the next ten years. Health care coverage will be dictated by the government. I would strongly suggest that citizens become more involved in their civic duties; voter apathy certainly has led us down a very dangerous path, but it is not too late to make a difference.

The ACA, while constitutional as a tax, is not set in stone and can be changed. I strongly urge all citizens to call for term limits so we stop serving the career politicians (you know, those who conveniently exempted themselves from the ACA).

Once pre=existing coverage is required, rational persons will forgo health insurance (because the $695 penalty is cheaper than a decent health plan premium) when they are healthy and wait UNTIL they are sick to get health insurance. The system will be full of healthy people outside they system and sick people in it. It is fiscally unsustainable the way it is designed. The ACA is a frightening monsterZ: a mix of free market principles and goverment controls that will accomplish much less than either a truly free market or a single payer system could...

The federal plan relies on a multitude of tax increases to fund it, Romney's didn't. The MA plan affected only those individuals in the state who did not have coverage. The federal plan is affecting everybody in the nation.

I think that since it could only be deemed constitutional as a tax, it should go back to the House to be voted on by Congress. I'd like to see which representatives back the ACA now that it is has been identified as a tax by the Supreme Court.

You know that old saying: Tax what you what less of, subsidize what you want more of? There will now be a 2.3% excise tax on medical devices as part of this "affordable" act. Any person needing a wheelchair, a prosthesis, a pacemaker will now pay more for these products. The ability to deduct your health care expenses from your income for tax purposes, which currently stands at 8.5% of income now goes up to 10% of income, which means that the people who need it most, people with large health care expenses, will now have to endure even more expense before getting a tax deduction. How does this help the middle class?

From Expats in Italy: "The best private hospitals in Italy are also the equal of those in any country. However, state hospitals, particularly in the south of the country, are notoriously bad, a situation made worse by Mafia-inspired corruption and doctors fleeing to find work in better equipped (and run) hospitals in the north. Throughout Italy, nursing care and post-hospital assistance are also well below what most northern Europeans and Americans take for granted."

Debbie, we have personal experience with how bad the Italian socialized health care system is. My Italian mother-in-law broke her arm in a fall in Italy in the last 10 years, and went to the local clinic. They didn't have a doctor available, so she was treated by a government "health care assistant". They improperly set the break, and she needed surgery to fix it right when she got back to America.

Healthcare in Canada is about the same, except their "Death Panels" are already in place and killing people. We had two family members there who had coronary disease and their doctors prescribed bypass operations, but the local "death panel" said they were too old (73 and 47) to get immediate care. About six months after that they got their care, as part of their final treatment from massive fatal heart attacks.

In the US they would have received this care within a week, and likely would still be alive today.

That's where Obama wants to take us, folks, and its a road we need to get off of!

Lots of problems here.
1. Fiscal reality.
2. Not enough doctors.
3. As the secretary shall determine.
4. Fiscal Reality.
5. Not enough doctors.
6. The government can't run a fruit stand, let alone the country's heath care system.
7. Reality vs. Idealism
8. Our governments are broke and people like to get paid for their work.
9. We still need a real solution based on fiscal and physical reality.
10. When we have an emergency, we are used to being able to have our lives saved immediately by competent caring doctors even if we can't afford it at the time.

Under this new care law, doctors will be carrying the brunt of the $ loss.
more folks requiring more care than their plan provides that is not covered.
But if all tests are not performed they have potential to be sued for future problems.
Guess who will pay more in their liability insurance...doctors.

"Your coverage will not change"
but what is changing is the requirements describing steps to choose procedures.
Unless you have specific symptoms, tests will not be done to chase a problem.
Thus you wont be denied a test, you just will not fit the "new" parameters for being tested.

Perfect solution.

Tell folks they are better off and they believe it.

For those of you who will argue ACA is not universal care, I ask you to do a quick search and you will find a quote from from someone involved with getting the ACA passed whom admits that it is just a transition mechanism to single payer government healthcare. I tend to believe that person because as it has been designed it is impossible to fund, at which point we will be told that the only way to fund it (Fix the funding issue) is to transition it to a single payer government program whereby we will all be forced to accept what they give us. We still do need a solution to many problems with our health system, but this one isn't it.

Paul, you are so correct but, you will always get the same old tired arguments from the same fear mongering conservatives chalk full of info from the ultra conservatives.The biggest reason there is a huge push back by the right is because they want to defeat Obama and they feel if they keep showing outrage over the ACA they will succeed.
Romney care = Obama care and is working fine since it was implemented in Massachusetts in 2006 with 60+% approval and 98% coverage in the state.

But who says something that works for MA will work for CA or LA or IL!? Just because something works at a state level doesn't mean it'll work federal...and it won't work on a federal level. The federal gov't needs to back off and let the states handle it.
If you're middle class, I'm curious how you're going to be able to pay for all these great new TAXES. As a 28 year old, earning a mere $40,000 a year...I can't afford health insurance...and nor will I be able to in the future. Hmmm $400/mo premium for insurance or a HUGE penalty for not having it? Looks like a lose-lose.
And to the argument "if you can't afford it, you're eligible for gov't assistance!...uhh who funds that? Oh yeah, more taxes.

Russ, the MA plan is a state plan and does not rely on raising taxes on everybody. The ACA is a federal plan and relies on taxes from all citizens. The MA plan is now reducing services in order to attempt to contain costs.

There is no doubt that our health care system is in need of reform, and far left and far right ideologues will always find fault in the other. What happened here unfortunately is the Democrats took the health care issue in back rooms and created a tax monstrosity throwing around payoffs in exchange for support, lied to the citizens about it NOT being a tax, provided union exemptions for political support, and debated this issue with absolutely no transparency. It was created with lies and bad intentions under cover of partisanship and payoffs and exemptions. It's basis has always been a tax increase, and the people were lied to. It was argued before the SC that is was a tax by the government's attorney, and the SC stated it is constitutional as a tax. It was nothing more than a bait and switch on the American people.

The health care issue was hijacked and crafted by left wing ideologues. We have 21 more taxes and a lack of trust. And I would be saying the same had it been right wing controlled. I would be arguing against such a deceitful, disengenuous process.

I wish the government would stay out of my business. It is not their business if I have health insurance or not. This will cost 2-3 times more than the CBO projected just like medicare has gone in the crapper. The government does not have the Midas touch, everything thy touch rots from the inside. Little by little we give up our liberty and freedom; what will the same supporters say when the government begins to tax you because you didn't buy a certain car or window or shoe or whatever? Iit is now limitless.

If you want to have the govt making your decisions, then move to one of those countries that already do that, and are failing.

Yep, Denise, ask military people how they view being forced to accept gay lifestyles in the military. Ask them why they often get inferior equipment because politics forces the military to buy materials based upon whose campaign the vendor contributes to or whose congressional district will get the work.

Ask the military about how much they like the idea of fighting in wars without a clear strategic goal, or putting their lives at risk because of political restraints put on them by ignorant, corrupt polticians who have nothing but comtempt for the military (see Clinton, Bill and Obama, Barry).

The amazing thing about our incredible military personnel is that they adapt, improvise and overcome the bureaucratic "rot" that the government created.

Bob, I'm not even going to try to understand what you're getting at with the contradictory Pres. Clinton and Pres. Obama bashing, but what has got me most nonplussed is your idea that our military personnel are homophobic.

Statistics, articles, and reports pile up and they all say that military people and Americans as a whole are more and more accepting of gays and lesbians serving in the military. As for "gay lifestyles" in the military, I've never enlisted, but from what I glean from American pop culture and friends who have served, there is no room for any "lifestyle," gay or otherwise, in the military. Not a lot of time for scrapbooking or refurbishing classic Mustangs-- I think they're generally too busy to exercise anything but a military lifestyle. For my good friend Kristen, a First Lt in the Army, her third tour in Afghanistan is different from her first two because this time, if she gets a letter or a care package from her fiancee, she can actually use the word "fiancee" without breaking the law.

If a culture that allows my friend Kristen to simply mention a significant other back home is unreasonable to you, Bob, I don't know what else there is to say. I am curious, though, when you say "Thanks to all of you for your service," are you counting Kristen and other lesbians and gays?

The Obama regime is following the same roadmap as they did in the Soviet Union and Cuba in order to enforce and strengthen their tyranny.

First, you "appoint" unelected bureaucrats that create their own law by regulation in order to reward your political allies and punish your opponents.

Next, you must eliminate the captitalists and intelligensia that would catch on to your oppressive ways and perhaps provide resistance to your tyranny. You do this by impoverishing them through taxation or confiscation, as Obama is attempting to do in his tax policy and through hurting the medical professionals in order to enlarge his bureucracy (50,000 new IRS agents are expected to be hired to enforce the "mandates")

You then need to diminish and demean the military, and transform it through those who are your poltical allies. You remove by fiat rights of association with what some consider perverse behavior, and forbid them even to criticize it without being disciplined.

You need to diminish and dissolve religion and families by forcing churches to perform acts and accept behavior against the basic tenets of their religion. You discourage institutions such as marriage between a man and a woman, and make a mockery of it by same sex marriage. You subsidize out of wedlock birth (multiple times) to replace the role of the father with the state.

Finally use the press, called "useful idiots" by Lenin to spread their lies and discourage real debate.

Yes, the Affordable Care Act, with a mandate based on an original idea first put forth by the Republican Party and modeled on the plan Mitt Romney put in place in Massachusetts. Certainly, it must be socialism and communism, you do know there is a difference between the two, right? We already have a Federal mandate and healthcare coverage, it's called Medicare and we as taxpayers have no choice in the matter.

Just admit that, regardless of what President Obama says or does, you will hate him anyway. Even if he's doing something for the benefit of the country or you in particular. The sad thing is if he made every right decision, half the country will hate him and the same goes for the next Republican President, the other half of the country will hate him. Partisan politics is killing our country, not any individual President.

And before you comeback typing in capital letters that I'm a typical left-wing liberal, keep in mind that I have voted for every Republican candidate for President since my first election in 1980. I'm just middle-ground, leaning right but try to look at things in a rational manner when I cast a vote.

Ivent, you tell people to educate and you don't even know what you are talking about. No where in the act does it say that anyone is required or will be forced to be implanted. All that was called for was a registry to be set up to track medical information by the Dept of Heath and Human Services. Things such as pace makers, insulin pumps and other implantable devices. This chip is not required and would need a patients consent. Besides, do you know how much time and lives can be saved if a doctor knew a sick patients history immediatley during an emergency?

The Actual health care plan is 955 pages- so anything that says it is on page 1000 is a lie.
The largest problem with this act is that nothing requires the doctors to see and treat patients on this ins. If I can't afford $600/mth policy with a $3000 deductible ($5000) family with co-pays and etc- how am I going to afford pre-exsisting policy that is more expensive? Also, i would love to even think about making $50K a year! when jobs are paying $10/hr you are not making it!
And everyone is all "get rid of Obama" do you think the Republicans are going to revoke it Feb 2013?? no- why would they?
And before you say oh you are for Obama- Actually I don't know who to vote for- they both are not going to fix everything that is wrong without cooperation of the house and senate.
